Contracts for webcam model

The interested ones on Webcam Modeling usually ask me things like: ¿Do I have to sign a contract? The answer is that it depends on the studio and their policies, although you might want to consider:

  • Some studios do not have contracts or binding clauses, grating full autonomy to the model for retirement whenever she desires
  • Some studios have contracts for “service provided”, the way I see it, this contract is ideal because it allows the model to quit if she wants to and protects the studio against any labor demand by the model. Both parts are protected.
  • “IMAGE RIGHTS RELEASE AGREEMENT” (Model Release). These are generally very extensive contracts with a lot of “fine print”, long clauses and endless paragraphs.
  • Some assignments of contract rights are fair, committing the studio to protect the personal data of the model, and offering in exchange advertising the model’s Nickname (stage name) to position the model as a brand.
  • If the studio fulfills their end, and invests time and money in advertising guidelines to make the model grow in followers and customers, and the model signs the assignment of contract rights, if the model wants to withdraw, she can’t use her stage name on other pages and / or networks, involving her start with another name to continue her webcam modeling career.
  • Retiring after signing the image rights release agreement does not implies that the model can’t continue working as a webcam model, to the webcam sites that kind of contract is invalid. It only applies to the stage name (nickname) on which the studio worked on to make the model grow as a brand. In that case, the studio is the “owner” of the Nick (by signed authorization of the model on the contract and that the Colombians laws protects on an “image rights release agreement” contract.)
  • An image rights release agreement with wealthy clauses are to be taken carefully, they should be reviewed and read well. YOU MUST KNOW WHAT YOU ARE SIGNING. If there are still payments made in favor of the “model” at the time she retires, these payments will cover partially or totally the penal clause of a HUNDRED MILLION PESOS, $ 100’000.000.
  1. If the “model” shares her personal data like real names, personal e-mail, WhatsApp or phone numbers with the website users she works for, there will be an effective pecuniary penalty clause in favor of “ENTREPRENEUR” equivalent to TWENTY-FIVE MILLION PESOS, $ 25’000.000.If there are still payments made in favor of the “model” at the time she retires, these payments will cover partially or totally the penal clause of TWENTY-FIVE MILLION PESOS, $ 25’000.000.
  1. In the case of managing social media such as Instagram, Twitter, Facebook and/or WhatsApp, the “MODEL” shall provide to the “ENTREPRENEUR” appropriate login information to enter. Said login information will be the username and password. To not provide the login information with the “ENTREPRENEUR” there shall be an effective pecuniary penalty clause in favor of “ENTREPRENEUR” equivalent to FIFTEEN MILLION PESOS, $ 15’000.000. The value of the pecuniary penalty clause that becomes effective shall be considered as partial or final payment for damages caused, without excusing them from fulfilling the contract. If there are still payments made in favor of the “model” at the time she retires, these payments will cover partially or totally the penal clause of FIFTEEN MILLION PESOS, $ 15’000.000.

Before signing a contract, I recommend reading carefully every single clause, if any of them if any of them is not understood is essential to investigate and ask, and if necessary consult with an attorney. When it is clear what the contract is about, if you agree you can sign and keep a copy. You have to protect yourself very well and the best way to do it is investigating, seeking to understand the text very clearly.
